  • Wells v. Parole Board and SSJ; Walker v. SSHD [2007] EWHC 1835 (Admin) Criminal: IPP sentences have been held to amount to unlawful detention once the tariff period has expired in cases where the offender has not been permitted access to the courses needed to satisfy the Parole Board that he no longer poses an unacceptable risk to the public.
  • P4 Limited v United Integrated Solution plc [2007] Costs; Mediation. Is mediation now compulsory? A claimant succeeded on the merits of the case but failed to beat the defendant's Part 36 offer. The defendant would normally have been held, for costs purposes, to have been the successful party. In this case the court decided that the defendant had unreasonably refused an offer to mediate and in consequence the claimant was awarded costs (on a standard basis) from the date the Part 36 payment could have been accepted.

    24/10/07 (JAM): Woolmer Inquest – Experts Testify Over Post Mortem Concerns On day two of the inquest into the death of Pakistan's former cricket coach Bob Woolmer, additional evidence was given by consultant forensic pathologist, Dr. Nathaniel Carey. Another pathologist later became the third doctor to publicly criticize the autopsy.


    22/10/07 (UK): Cocaine Smuggler Appeals Over Non-Disclosure Of Evidence William Gavin Grant was arrested in 2002 and charged with trying to import one of Scotland's largest consignments of cocaine, worth an estimated £50m. He is now is to appeal his case following the discovery of new evidence.


    16/10/07 (USA): Discredited Dentist Leads To Retrial A woman convicted of first-degree murder more than a decade ago based on faulty bite-mark testimony will get a second chance before a jury. The testifying expert at trial, however, has since been discredited by other forensic dentists who examined his work and found his conclusions unreliable.


    14/10/07 (UK): Unlocking The Secrets Of Cot Death A major new report has revealed that smoking holds the key to a mystery that has baffled doctors and brought heartache to thousands. Nine out of 10 mothers whose babies suffered cot death smoked during pregnancy, according to a scientific study to be published this week.


    12/10/07 (UK): Racing Experts Give Evidence At Fallon Trial The trial of Kieren Fallon and five other defendants, who all deny conspiracy to defraud, yesterday heard evidence from William Nunnelly, a senior stipendiary steward for the British Horse Racing Authority, formerly the Horse Racing Regulatory Authority (HRA), and the Jockey Club before that.


    12/10/07(UK): Lockerbie Conviction In Doubt As Witness Discredited Lawyers for a Libyan man convicted of killing 270 people in the Lockerbie bombing have found a new witness who casts doubt on the reliability of the main prosecution witness in the case.


    12/10/07 (UK): Gore – An Inconvenient Fantasy? A Court Decides After hearing expert testimony, a judge in the High Court has ruled that Gore's apocalyptic movie on climate change, ‘An Inconvenient Truth’, should come with a warning that it promotes "partisan political views" and is riddled with errors.
