Last month's news item about the 'Fake Bad Scale' used to detect malingering seems to have caused a stir. We've been asked if we could find further sources and have included them in the 'Articles' section below. We hope that experts and solicitors alike will find this useful. Please remember that we always welcome contributions by experts and lawyers, and we'd love to hear from you with your feedback - positive or otherwise.
Law
  • R.v. Bakish Alla Khan and others [2008] EWCA Crim 531 14/03/08. Criminal. Judgment now handed down by the Court of Appeal which had to balance the rights of police officers as citizens being allowed to sit on juries with the defendants' rights to a fair trial. The upshot appears to be that the trial judge must be made aware of a juror's connection with the police, past or present, and that such matters should be dealt with on a case by case basis.
  • Porter-v- Shepherds Bush Housing Association [2008] EWCA Civ 196 18/03/08. Landlord & tenant. Court of Appeal judgment confirming that Housing Act case law as set out in Marshall v Bradford MBC is the correct approach re secure tenancies.
