Orr v Milton Keynes Council [2011] EWCA Civ 62 Employment. Reasonableness of decision, based on facts known to the decision maker, is the important factor. The Court of Appeal (Civil) so held when dealing with an unfair dismissal case where a decision to dismiss for gross misconduct was based on information that was incomplete.

R v Mullings [2010] EWCA Crim 2820 Criminal. Bad Character. The Court held that s. 98(a) of the CJA 2003 should be narrowly interpreted so that the words "has to do with the alleged facts of the offence" are taken to mean that a close temporal connection must exist between the event, evidence of which it was sought to adduce, and the "alleged facts of the offence".

Charles v C.P.S [2009] EWHC 3521 (Admin) Criminal. PACE A case that slipped under our Newsletter radar, but an important one. The courts are appearing to take a more robust attitude on PACE breaches. This one dealt with a failure to caution properly in a drink drive case.

03/03/11 (USA): 'False Confession Expert' Allowed To Testify As the U.K sometimes follows U.S trends, it's interesting to note that a U.S federal judge will allow testimony from a lawyer who specializes in the subject of false confessions in an upcoming arson trial.


20/02/11 (UK): UK CDO Expert In Demand City investment banks are in talks with the star witness who helped Barclays win a landmark case on complex securities to help them with similar legal challenges. David Ellis, the managing director at FTI Consulting, gave evidence for the bank when it was alleged to have mis-sold collateralised debt obligations (CDOs) during the financial crisis.
