Welcome to our 16th edition. As usual we've included plenty of items that will interest legal professionals and experts alike. We welcome your articles for circulation, and we'll provide links to your website and email if asked. Just send them in PDF or Word format to admin@xproexperts.co.uk. 'X-Pro News' is circulated to thousands of solicitors and experts each month so it's great marketing and totally free. We also welcome articles from solicitors who would like to share their experiences with fellow professionals. Even we need a break occasionally so there will be no September edition of 'X-Pro News'. Have a great summer and we'll be back for the October edition.
Law
  • R v Mustafa Nour Kulah 13th July 2007. Criminal, Court of Appeal. Useful guidelines set down when courts are asked to give a Goodyear direction on sentence whilst dealing with specified offences within Schedule 15 to the Criminal Justice Act 2003.
  • Re C (Residence Order) 3rd July 2007. Family. A remarkable illustration in speedy justice, as well as how the family courts are dealing robustly with failed contact cases.
  • JP Morgan Fleming Claverhouse Investment Trust plc v HMRC 28 June 2007. Taxation, ECJ. The ECJ has held that the UK does not have a free hand to determine the identity of "special investment funds" for the purposes of exempting from VAT management fees, but must have regard to the overriding principles of fiscal neutrality and treat like funds in the same way.
