  • PD & MD [2008] EWHC 403 (Fam): Family. A judge has recognised an Indian adoption of two children made under the Hindu Adoption and Maintenance Act 1956, despite India not being a signatory to The Hague Convention or the Adoption (Designation of Overseas Adoptions) Order 1973.
  • Norris v Government of the United States of America [2008] UKHL 16: Corporate Crime. The House of Lords has settled the controversy around when a cartel might constitute conspiracy to defraud, shielding Mr Ian Norris from extradition to face a price fixing charge. But his troubles aren't over yet.

    20/03/08 (UK): Expert Caught Out in 'Bad Character' Application The evidence of an animal behaviour expert who has been an expert witness in court cases across the UK was discredited yesterday due to a 'bad character' application by the prosecutor who showed magistrates a documentary "sting" in which the expert was apparently caught on hidden cameras changing his opinion.


    11/03/08 (USA): Only in America? 'Eyewitness Experts': A New Trend After a mugging victim positively identified Jarvis Davis as his assailant, the matter proceeded to trial. During the defence case an expert witness was called who gave evidence about the need for caution when dealing with identification.


    10/03/08 (USA): Malingerer 'Fake Bad Scale' Test Under Fire Despite Support Since personal injury litigation began there were always untruthful plaintiffs - malingerers who lied about the extent of their injuries in order to get the best pay day. However, a test has been developed by a psychologist in the U.S. which has rapidly gained approval by experts far and wide and which roots out such litigants.

    9/03/08 (UK): Nightclub Hires Expert On Appeal An expert witness was hired by a nightclub in Swindon after the premises was handed a closure order by the local authority. Terry Davies, a security expert, told the court about his experiences at 'Angelo's', which has been dubbed 'the most dysfunctional in Britain'.


    23/2/08 (CAN): Be Cautious With 'Experts' Says Top Canadian Judge The public inquiry into the Dr Charles Smith debacle (see last month's edition of 'X-Pro News') has heard that courts tend to elevate experts to a higher level than ordinary witnesses and give them too free a rein.
